Privacy Policy

GrantVantage, Inc., a Virginia corporation (“We,” “Our,” “Us” and similar derivatives), accords the highest priority to protecting the privacy of Our users, including you (“You,” “Your” and similar derivatives).

This Privacy Policy (this “Privacy Policy”) informs You about the nature of the information that We collect and how We use, protect and sometimes disclose such information.

1. Definitions

2.1.                “Content” means text, photographs, slides, graphics, drawings, artwork, audio, video, email lists or information contained in any database, template, message, audio, or any other form of audio or visual effect in any media now or hereinafter developed by you, including without limitation the content of Message(s) and content contained on web sites which are accessible via hyperlinks placed within Messages.

2.2.                 “Message” means any and all written, electronic, or other materials and content provided by you, which may be implemented or distributed by GrantVantage through its network servers.

2.3.                “Our Sites” means the GrantVantage web site at https://www.grantvantage.com, and in the Software.

2.4.                “Software” means the GrantVantage business solution, built on Microsoft Dynamics CRM and hosted online at Microsoft Azure.

2. Amendments and Updates

This Privacy Policy was last updated on August 17, 2018 and is subject to amendments, updates and/or changes at any time without any prior notice to You or anyone else.  All such modifications shall come into effect immediately upon posting on Our Sites at https://www.grantvantage.com/legal/privacy/ .  You are advised to visit Our Sites periodically for the latest on this Privacy Policy.

3. Privacy of Children

We comply with the principles and provisions of the Children’s Online Privacy Protection Act of 1998 and do not knowingly collect any personally identifiable information from children below the age of thirteen (13) years without the consent of such child’s parent.  If You are under eighteen (18) years of age, then You are expressly prohibited from using Our Sites pursuant to the terms and conditions of End User License Agreement located at https://www.grantvantage.com/legal/eula/(“Our EULA”) , which is incorporated herein by reference.  In the event that We inadvertently collect any personal information from a child below eighteen (18) years of age without the consent of such child’s parent, We encourage Our users to bring to Our attention all such instances.  We shall take all reasonable steps to delete such information from Our servers.

4. Collection of Information

We may collect personally identifiable information from You, including, but not limited to, Your name, date of birth, email address, phone number and postal address, when voluntarily submitted to Us by You. In addition, We may collect personally identifiable information that You add to Your user profile.

We may use third-party analytics tools to analyze Your use of Our Sites (including without limitation Your session length and what content You view), Your location, Your mobile phone and/or other mobile device information, any crashes and/or glitches relating to Our Sites, and other use and demographic information. However, We do not rent or sell any of the information that We collect to third parties.

In order to use Our Sites, You may be required to submit certain contact information, including, but not limited to, Your name, email address, phone number and billing addresses and payment information, to Us and/or to Our third party payment processor(s) and/or Our other service providers.  Payment information may include Your credit card and/or online check information.  We, Our third party payment processors and/or Our other service providers may collect and store Your payment information and transmit Your other contact information so that We can fulfill Your order.  We may store Your contact information and may contact You at any time with future news, advertisements, survey requests and updates, unless You choose to-opt out, as described in Section 5.

5. Opt-In and Opt-Out

We only send news, advertisements, survey requests and updates to individuals who opt‑in to receive such information.  If You use Our Sites, then You agree to opt-in to receive this information.  If You no longer want to receive such information, then You can change these settings by sending an email to unsubscribe@GrantVantage.com. You may also receive mail and/or email from Us containing information on new services, products and/or upcoming events.  If You do not wish to receive such mail and/or email, please let Us know by sending an email to unsubscribe@GrantVantage.com.

6. Collection and Use of Non-Personal Information

In addition to the above-mentioned personally identifiable information, when You use Our Sites, We may also collect certain non-personal information, including, but not limited to, the type of browser used to access Our Sites, the Internet Protocol Address (“IP Address”) of Your computer, the IP Address of Your Internet Service Provider and Your mobile phone and/or other mobile device information used to access Our Sites.  We may collect this information directly, or use a third party to collect this information on Our behalf.  Generally, this information is used to improve the layout and content of Our Sites, provide You with customized advertisements from third-party advertisers, analyze Our Sites’ usage and enhance Your overall experience.  All such non-personal information is kept confidential and is not shared with, or rented or sold to, any third party.

7. Collection and Use of Cookies and Similar Technologies

Cookies are small text files that are placed on the hard disk of Your computer system, mobile phone and/or other mobile device by a webpage server.  The cookies (and similar technologies) are employed to determine certain information, such as how You use Our Sites and how You use Our services.  The cookies are also used to remember the repeat visitors to Our Sites without any requirement to login repeatedly while the session is on.

Log file information is automatically reported by Your browser each time that You make a request to access Our Sites.  Log file information can also be provided when the content of Our Sites is downloaded to Your computer system, mobile phone and/or other mobile device.  When You use Our Sites, Our servers may automatically record certain log file information, including, but not limited to, Your web request, IP address, browser type, referring / exit pages and URLs, number of clicks and how You interact with links on Our Sites, domain names, landing pages, pages viewed and other similar information.

Our Sites may also contain links to third-party websites of promoters, advertisers, affiliates, partners, agents, etc.  However, We do not review, control or monitor in any way the privacy practices of such linked third party websites.  Therefore, We recommend that You review the policies and procedures of any linked websites before interacting with them

9. Disclosure of Your Information

Our use of Your personal and non-personal information is strictly in accordance with the policies and provisions outlined above, except as it relates to:

9.1.                 disclosure to government agencies in response to legal processes, such as subpoenas;

9.2.                 any unlawful or unauthorized access to and transmissions of information from Our Sites;

9.3.                 disclosure of any photographs or information by You on message boards, public forums, blogs, social networking websites or any other publicly accessible online or offline media; or

9.4.                 disclosure of such information as an asset on account of the sale, or partial sale, of Our Sites to a third party.

10. Storage and Processing of Information

Your information collected by Us may be stored and processed in the United States or in any other country in which We and/or Our service providers have facilities.  We and/or Our service providers may transfer such information across state and country borders.  If You are located in a region with laws governing data collection and use that differ from United States law, then please note that we may transfer information to a region that does not have the same data protection laws.  By using Our Sites, You consent to any such transfers of information.

We use reasonable safeguards to try to keep Your information secure and take reasonable steps to verify Your identity before granting You access to Your user account on Our Sites.  However, We cannot ensure the security of any information that You transmit to Us or guarantee that such information may not be accessed, disclosed, altered or destroyed.

11. User Privacy for Messages and Content

GrantVantage considers Your Messages to be the private correspondence between You and the email recipient.  GrantVantage will not monitor, edit or disclose the contents of Your private communications without Your prior permission, except that You agree that GrantVantage may do so: (a) as required by order of a government agency or court of competent jurisdiction; (b) to comply with a legal process; (c) if necessary to enforce this Privacy Policy or Our EULA; (d) to respond to a good faith belief or third party claims that such contents violate the rights or interests of a third party or Our EULA.

GrantVantage will, prior to disclosing the contents of Your private communications to any third party, provide notice to You of the details of any claim or other circumstance that may allow disclosure under this section.  You understand and agree that technical processing of Messages is and may be required (i) to send and receive Messages; (ii) to conform to the technical requirements of connecting networks; (iii) to conform to the limitations of the Software; (iv) to conform to other, similar technical requirements, or (v) to conform to this Privacy Policy.

12. NO “spamming”

You will comply with the CAN-SPAM Act of 2003 (the “Act”) and will not use any distribution lists with the Software that include persons who have opted out of receiving email communications specifically from You.  You are required to include a valid opt-out mechanism and physical address for You or Your organization in each Message, which is clearly displayed and easily accessible by the recipient.  You will honor all opt-out requests within ten (10) days.  You will not use any false or fraudulent header or routing information in Messages sent by You.    You further agree to comply with all applicable laws in any jurisdiction in which You use the Software and in any jurisdiction where recipients of Messages sent by You through the Software are domiciled.

13. Data retention

You agree that You will retain back-up copies of all Content provided for use in connection with the Software.  GrantVantage may archive and/or destroy all copies of Messages and Content immediately following termination of the license agreement that applies to Your access to the Software, and in any event all Messages and Content may be purged from GrantVantage’s network and systems ninety (90) days following termination of the license agreement that applies to Your access to the Software, unless otherwise agreed in writing with You or with the licensee for the license agreement that applies to Your access to the Software.
